1. Agreement

These Terms of Service ("Terms") govern your access to and use of GaraheCMS websites, applications, and related services ("Services") operated by GaraheCMS. By using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. The Services

GaraheCMS provides software for automotive shop management. Features, availability, and pricing may change, especially during beta or preview periods. We may modify, suspend, or discontinue any part of the Services with reasonable notice where practicable.

3. Accounts

You are responsible for safeguarding login credentials and for activity under your account. You must provide accurate registration information and notify us promptly of unauthorized use.

4. Acceptable use

You agree not to:

• Violate applicable laws or third-party rights;
• Probe, scan, or test the vulnerability of the Services without authorization;
• Interfere with or disrupt the Services or other users;
• Upload malware or attempt unauthorized access to systems or data;
• Reverse engineer or attempt to extract source code except where law permits.

5. Your data

You retain rights to data you submit to the Services. You grant us a license to host, process, and display that data as needed to provide and improve the Services. Our Privacy Policy explains how we handle personal information.

6. Beta services

Beta or preview features may be unstable or incomplete. They are provided "as is" without warranty. We may change or end beta access at any time.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GARAHECMS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF NONE, ONE HUNDRED PHILIPPINE PESOS (PHP 100)).

9. Indemnity

You will defend and indemnify GaraheCMS against claims arising from your use of the Services, your data, or your violation of these Terms, to the extent permitted by law.

10. Governing law

These Terms are governed by the laws of the Philippines, without regard to conflict-of-law principles. Courts in the Philippines shall have exclusive jurisdiction, subject to mandatory consumer protections where they apply.

11. Changes

We may update these Terms. We will post the new Terms on this page and update the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.
